1. Who we are

2. Accepting these terms

By downloading, installing or playing a Bawalt game, you agree to these Terms of Service and to our Privacy Policy, which explains how information is handled. If you do not agree, please do not use the game and uninstall it. The terms of the app store you downloaded the game from (for example, Google Play) also apply to your download.

3. Age and eligibility

Our games are intended for players aged 13 and older and are not directed to children under 13. If you are under the age of legal majority where you live, please review these terms with a parent or guardian, who agrees to them on your behalf.

4. Your license to play

We grant you a personal, limited, non-exclusive, non-transferable and revocable license to install and play our games on devices you own or control, for your own non-commercial entertainment. You may not copy, modify, sell, rent, redistribute, reverse engineer or create derivative works of our games, except where the law expressly allows it.

5. Coins, tools and other virtual items

Our games may let you earn or receive in-game coins, tools (such as bombs or new pieces), themes, stars, scores and similar items (“virtual items”). Virtual items are part of the game experience only: they have no monetary value, cannot be exchanged or refunded for real money, and cannot be transferred or sold. Game progress and virtual items are stored on your device; uninstalling the game or clearing its data may delete them, and we cannot restore them.

We may adjust game balance, prices of virtual items in coins, rewards and features as we improve our games. If we offer paid in-game purchases in the future, they will be processed by the app store under its payment terms, and we will update these terms before they become available.

6. Advertising

Some games are supported by advertising from Google AdMob, such as optional rewarded videos (for example, to receive a bonus or a second chance) and occasional full-screen ads. Ads are provided by third parties; we are not responsible for the content of third-party ads or for products and services they offer. How advertising uses information, and the choices you have, are described in our Privacy Policy.

7. Fair play

Please do not cheat, hack or modify our games, interfere with their operation, use bots or automation, or manipulate advertising (for example, by repeatedly clicking ads or generating fake views). We may limit features or rewards where we reasonably detect such behaviour.

8. Our content

Our games, including their code, graphics, characters, music, sounds and text, are owned by Bawalt or its licensors and are protected by intellectual property laws. “Bawalt”, “Gemwood” and “Kingsveil” and related logos are our trademarks. These terms do not give you any ownership of our content.

9. Third-party services

Our games may rely on services provided by others, such as Google Play and Google AdMob. Your use of those services is also governed by their own terms and privacy policies.

10. Updates and availability

We may update our games to fix problems, add or change content, or keep them compatible with devices and laws. Some updates may be required to continue playing. We may also change, suspend or discontinue a game; where reasonable, we will give advance notice in the game or on our website.

11. Disclaimer

We work hard to make our games fun and reliable, but to the extent permitted by law they are provided “as is” and “as available”, without warranties of any kind, including that they will be uninterrupted or error-free.

12. Limitation of liability

To the extent permitted by law, Bawalt is not liable for indirect, incidental or consequential damages, or for loss of game progress or virtual items, arising from your use of our games. Because our games are free, our total liability to you for any claim is limited to the greater of the amount you paid us in the 12 months before the claim (if any) or USD 50. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, such as liability for death or personal injury caused by negligence, or for fraud.

13. Your rights as a consumer

If you are a consumer, you keep all rights that the consumer protection laws of your country give you, and nothing in these terms limits them. This includes the mandatory rights of consumers in the European Economic Area, the United Kingdom and Switzerland. Bawalt llc acts as a trader in relation to its games. If you have a complaint, please contact us first at info@bawalt.com so we can try to resolve it. EU consumers may also use their national consumer authorities or out-of-court dispute resolution bodies.

14. Governing law

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-law rules. If you are a consumer living outside the United States, this choice of law does not deprive you of the protection of the mandatory laws of your country of residence, and you may bring claims in the courts of your country.

15. Changes to these terms

We may update these terms from time to time, for example when we add features or when laws change. The effective date above shows the latest version. If we make significant changes, we will let you know in the game or on this page before they take effect. Continuing to play after changes take effect means you accept the updated terms.
